I meant it gave them an excuse escape clause. I do not think it gives them a legal escape clause. When interpreting laws, courts always look for the intent of a law to resolve ambiguity. As written, the first clause was clear in it's intent. How to resolve tie breaks amongst 3 or more teams tied on points.
