Default News: The High Court on Sunday declared the amendment to the constitution of Bangladesh Cricket Board (BCB) as 'illegal'.

Amendment to BCB constitution 'illegal': HC



The High Court on Sunday declared the amendment to the constitution of Bangladesh Cricket Board (BCB) as 'illegal'.
The National Sports Council (NSC) on November 29 last year amended the constitution of the BCB, saying that the board executive committee will be nominated through selection instead of holding election.

Delivering the verdict, the HC said the NSC has no authority to amend the constitution of the BCB.

The HC bench of Justice Sarah Mahbub and Justice Abdur Rab delivered the verdict after hearing the writ petition jointly filed by Yousuf Jamil Babu, president of the Bangladesh District and Divisional Sports Organisers' Association, and Mobasher Hossain, a former BCB director.

Are you saying ICC can suspend BCB over this? Why? It seems the HC said BCB must be more democratic and have elections, no?

So, if I get it right, this means the current structure, ie, One NSC director, will stay in order.
That means govt's wish of 2 more NSC director has been denied by the HC and will in turn help BCB to keep themselves 'relatively' free from Govt/NSC interference which is exactly what ICC wants.

So, this is a good decision by HC !

If the 2008 constitution is upheld then what does this mean for us in terms of ICC rules? As far as I understand we cannot have a government appointed president for BCB right?
can someone dumb it down for me?

In order to conform to ICC directives, the BCB EGM had made some changes last March that needed to be signed-off on by the NSC. What the EGM had suggested was to elect the president (currently appointed) by the councillors who include members of various clubs, districts, divisions, some institutions and ex-players with voting rights. NSC changed the proposed constitution by having teh BCB president elected by the directors. Additionally it also increased the number of directors it selected from one to three, therefore increasing the influence the government can have on the election of the president. Other than the one NSC selected director, the BCB remaining 23 directors are elected.

In addition to the above, the NSC's changes to the BCB Constitution included:
- The geographical restriction on where one could become a Councillor from being lifted
- Allowing the top six clubs in the Dhaka Premier Division Cricket League to have more Councillors than others

You can clearly see the scope for manipulation by vested interests and the weighing of the scales heavily in favour of already powerful Dhaka clubs.

While Isam says that the HCD order will re-instate the 2008 Constitution, it still leaves question marks over how elections will take place to replace the current ad-hoc committee. I wonder whether the court considered the possibility of issuing a 'mandatory order' (mandamus writ) to compel the NSC to accept the BCB changes suggested in March 2012, as per Article 11 of the BCB Constitution? Or did they give the BCB the opportunity to consider the issue of elections, councilorship, etc. afresh?

Perhaps you can file an Amicus Curiae brief? Hey, get your name out there. It's a good cause.
