Default SCOTUS upholds Obamacare

A good day for America.

In a dramatic victory for President Barack Obama, the Supreme Court upheld the 2010 health care law Thursday, preserving Obama’s landmark legislative achievement.

CNN making a huge blunder...hahahah

Not sure I've hated a judge as much as I hate Scalia. Roberts voting with the majority(big surprise tbh)

However CNN has summarized nicely the ruling:

Question: Can the court decide the constitutionality of health care now, or does it have to wait a few years?

To answer, the court had to decide whether a penalty the law imposes on people who do not have health insurance amounts to a tax.

A previously obscure law mandated that the legality of a tax cannot be challenged until it is imposed, and the health care law doesn't call for penalties until 2014.

The court's answer: The court upheld the entire law.

Question: Is the requirement that people have health insurance - the so-called individual mandate - constitutional?

The court's answer: Chief Justice John Roberts wrote that the commerce clause did not apply, but the mandate stands under the taxing clause.

Question: If the individual mandate is unconstitutional, can the rest of the law stand, or is the whole thing unconstitutional?

The court's answer: The mandate is constitutional, rendering moot further questions on the rest of the law.

Question: Can the federal government force states to expand their share of Medicaid costs and administration?

The court's answer: Yes, but the justices ruled that the federal government cannot remove existing Medicaid funding if the states choose not to participate in the new program.

Tbf I'm not sure if this is a good thing for Obama - politics aside, it obvious is. But in terms of politics, Obamacare was polling around at 30% last week, so there is massive distrust/confusion surrounding it.

The positive ruling today, will give it a bit of a bump for sure...but it'll also give the republicans something to campaign on, especially with Justice Roberts, calling it a 'tax'.

This will get repealed the first time the GOP assumes majority. Hopefully - it won't happen this time and long enough for the good parts to have embedded itself so well that it would be hard to repeal.

BTW - that's a real Obama signature. I really put my money where my mouth is, when it comes to universal health care. All the Republican who now want to leave the country, can't find a wealthy Western country without universal health care.

I think this is about right or at least hope how the public see it:

"If you ask people what they think, it's very predictable," said John Culhane, director of the Health Law Institute at Widener University. "Democrats support it, Republicans oppose. But when you parse out the individual parts of it, there are a lot of pieces that people like. Once it comes into place it'll become background and people will just live with it. In two years from now there won't be anything for people to yell about."

I can't fathom the logic behind all these "furious" faces at the camera when news channels ask republicans(read: tea party) on the street about their view. "The Socialist president killed our rights!" <--- wth is that?

Its also sad that some of these folks who are saying these things are from working class low income group; who are the very segment that would be benefited immensely by this healthcare. This group is the main target of overblown tea party arguments on "increasing deficit" and unfortunately they are falling for it. They are willing to give up their necessity just for the sake of argument. Most of these are relying on hearsay and rhetoric , without really understanding the issue at hand. Sad but thats the reality.

If republicans have so many folks who now seem to know millions of ways to fix healthcare; my question is where were those folks during Bush's 8 years?
