ব্রিটেনে পড়তে গিয়ে বন্ধুবান্ধব তৈরি এবং রোববার ক্রিকেট খেলার বদৌলতে ব্রিটেনে বসবাসের সুযোগ পেল বাংলাদেশি তরুন আব্দুল্লাহ মনোয়ার।

ব্রিটেনের অভিবাসী সংক্রান্ত একটি আদালত শনিবার মনোয়ারকে ব্রিটেনে বসবাসের সুযোগ দিতে ব্রিটিশ সরকারকে নির্দেশ দেন।

রোববার লন্ডন প্রবাসী বাংলাদেশিদের সূত্রে এ তথ্য জানা যায়।

আদালতের রায় ব্রিটেনের বাংলাদেশিসহ অভিবাসী শিক্ষার্থীদের মধ্যে ব্যাপক আলোচনার জন্ম দিয়েছে।

হিসাববিজ্ঞান সম্পর্কিত স্নাতক পর্যায়ের লেখাপড়া করার জন্য ২০০৮ সালে মনোয়ার বাংলাদেশ থেকে ব্রিটেনে যান। ২০১০ সালে তার লেখাপড়া শেষ হয়। এরপর দেশটিতে স্থায়ীভাবে বসবাসের সুযোগের জন্য আবেদন করেন ২৩ বছর বয়সী মনোয়ার।

পড়ালেখা করতে এসে ব্রিটেনে রয়ে যাওয়ার কোনও সুযোগ নেই- - এ বিধির কারণে ইউকে হোম অফিস (স্বরাষ্ট্র মন্ত্রণালয়) তার আবেদন খারিজ করে দেয়। তবে মনোয়ার আইনজীবীর মাধ্যমে বিষয়টি নিয়ে মামলা চালিয়ে যান।

প্রায় দুই বছরের আইনী প্রক্রিয়া শেষে শনিবার ‘আপার ট্রাইব্যুনাল অব দ্যা ইমিগ্রেশন অ্যান্ড অ্যাসাইলাম চেম্বার’ মনোয়ারকে ব্রিটেনে বসবাস করার সুযোগ দিতে হোম অফিসকে নির্দেশ দেন।

আদালত তার নির্দেশে জানান, যেহেতু মনোয়ার ব্রিটেনের সামাজিক কর্মকা-ে অংশগ্রহণ করছে এবং এদেশেই (ব্রিটেনে) তার ‘ব্যক্তিগত জীবন’ গড়ে উঠেছে তাই তাকে ব্রিটেনে বসবাসের সুযোগ দেওয়া যেতে পারে।

আদালত তার নির্দেশের ব্যাখ্যা দিয়ে আরও বলেন, ‘যেহেতু মনোয়ার এখানে পড়তে এসে বন্ধুবান্ধব তৈরি করেছে এবং শুধু তাই নয় ব্রিটেনের রীতি অনুযায়ী রোববার তিনি এখানে অন্য বন্ধুদের সঙ্গে ক্রিকেট খেলেন, তাই তার এদেশে বসবাসের সুযোগ রয়েছে।’

ব্রিটিশ অভিবাসী আইনের আর্টিকেল ৮ এবং ইউরোপীয় মানবাধিকার কনভেনশন অনুযায়ী মনোয়ার এ সুযোগ পেয়েছে বলে জানান বিচারক সুসান ভি পিট।

তিনি রায় দেওয়ার পর এক প্রতিক্রিয়ায় বলেন, ‘মনোয়ার এদেশে বন্ধুবান্ধবদের সঙ্গে সামাজিক যোগাযোগ গড়ে তুলেছেন, তিনি নিয়মিত মসজিদে যান, তিনি শিক্ষাজীবন ছাড়াও কর্মক্ষেত্রেও বন্ধুবান্ধবদের কাছে পরিচিত, তাই এদেশে বাস করার সুযোগ পাওয়ার অধিকার তার রয়েছে।’

অভিবাসী সংক্রান্ত আদালতের এ আদেশে ব্রিটেনের অভিবাসন সংক্রান্ত মন্ত্রী ড্যামিয়েন গ্রিন অবশ্য খুশি হতে পারেননি। শনিবার রাতেই এক প্রতিক্রিয়ায় তিনি বলেন, ‘আদালতের এ রায়ে আমি খুবই হতাশ।’

তিনি আরও বলেন, ‘এটা কখনোই গ্রহণযোগ্য হতে পারে না যে, মানবাধিকারের দোহাই দিয়ে সেসব অভিবাসীকে থাকার সুযোগ দেওয়া হচ্ছে তাদের এদেশে বসবাসের কোনও অধিকারই নেই।’

অভিবাসন মন্ত্রী স্পষ্টতই তার হতাশার কথা প্রকাশ করেন, কারণ ‘ব্রিটেনের ক্ষমতাসীন জোট সরকার চাইছে অভিবাসনকে নিয়ন্ত্রণে আনতে’।

বিশেষ করে, স্টুডেন্ট ভিসায় ব্রিটেনে যাওয়াদের ব্যাপারে ব্রিটিশ সরকার গতবছর থেকে কঠোর অবস্থানে গেছে। এমনিতেই ব্রিটেনের ৪৭০টি কলেজকে অ-ইউরোপীয় শিক্ষার্থী ভর্তির ওপর নিষেধাজ্ঞা জারি করা হয়েছে। এ অবস্থায় এ ধরনের রায় ব্রিটিশ সরকারের উদ্যোগকে বাধাগ্রস্ত করবে বলেই মনে করছেন সংশ্লিষ্টরা।

মনোয়ারের এ মামলার রায়ে ব্রিটেনে শিক্ষার্থী ভিসায় যাওয়াদের উৎফুল্ল হওয়ার মতো কারণ অবশ্যই রয়েছে বলে মন্তব্য করেন মনোয়ারের আইনজীবী তমিজ উদ্দিন।

তিনি বলেন, ‘ভবিষ্যতে একই ধরনের মামলার ক্ষেত্রে মনোয়ারের মামলাটি একটি নজির হিসেবে দেখানো যাবে। যদিও অন্য আদালত বা বিচারকরা যে এ রায়কে মানতে বাধ্য থাকবেন তার কোনও কারণ নেই।’

আদালতের রায়ের পর মনোয়ার বলেন, ‘এটা আমার জন্য খুবই সৌভাগ্যের ব্যাপার। কারণ ২ বছর ধরে মামলাটি চলছিল।’

তিনি বলেন, ‘এখানে আমি মসজিদভিত্তিক ধর্মীয় শিক্ষা কোর্সে ভর্তি হয়েছি, যা আমাকে বাংলাদেশের চেয়েও ধর্মীয় শিক্ষা বেশি দিতে পারছে।’

মনোয়ার জানান, তিনি সাউথগেট ক্রিকেট ক্লাবের একজন ফাস্ট বোলার।

আদালতের রায়ের পর এখন মনোয়ার ওয়ার্ক পারমিটের জন্য আবেদন করবেন। এছাড়া ব্রিটেনের মধ্যম মানের কোনও অ্যাকাউন্টেন্সি ফার্মেও চাকরির চেষ্টা চালাবেন।

২০১১ সালের জুন পর্যন্ত ২ লাখ ৭১ হাজার শিক্ষার্থী স্টুডেন্ট ভিসায় ব্রিটেনে যায়। ২০১০ সালে ২২ হাজার ৯৮৫ জন শিক্ষার্থীর স্টুডেন্ট ভিসাকে ওয়ার্ক ভিসায় রূপান্তরের অনুমোদন দেওয়া হয়।

প্রসঙ্গত, ২০১১ সালের ফেব্রুয়ারিতে করা এক জরিপে দেখানো হয়, ৭৫ শতাংশ ব্রিটিশ নাগরিক মনে করেন অভিবাসন ব্রিটেনের জন্য একটি সমস্যা।

A Bangladeshi student has won the right to remain in the UK - after he declared that his love of cricket proved that he was committed to British life.  

And there are now concerns that the controversial ruling could open the floodgates for thousands of foreign students to remain in the UK after completing their college courses.

Abdullah Munawar, 23, who has been studying in London, applied to have his three-year student visa renewed in 2010, but was turned down by the Home Office.

However, the accountancy student appealed that ruling, telling the Upper Tribunal of the Immigration and Asylum Chamber that he deserved to remain in the UK because he played cricket at weekends and had also formed friendships with students and work colleagues.

And in what could become a test case, Judge Susan Pitt ruled that the initial refusal of a visa renewal 'amounted to a disproportionate interference with private life that deserved respect'.

Critics claim that the decision could now pave the way for thousands of the 270,00 foreign students currently in Britain to win the right to remain here - because most can easily claim that they have made friends during their stay.

And that view was backed up by Mr Munawar's own legal advisor.


Not cricket: Lord Tebbit

'There is a strong possibility that we will be able to refer back to this case in the future,' Tamij Uddin told the Telegraph.

'Although this court's decision is not binding on other judges, there is a possibility to argue the significant points of this case in other appeals. In other words it is a test case.'

The decision was condemned by Immigration Minister Damien Green, who accused the courts of 'gold-plating' human rights legislation at the expense of a burgeoning immigration problem. Government has pledged to slash the number of foreigners entering Britain.

'It is unacceptable that the Human Rights Act is being used to prevent the removal of people with no rightto be in this country , and we are changing immigration rules to stop them being abused,' Mr Green told the Telegraph.

And former Cabinet Minister Lord Tebbit described the ruling as 'absurd' adding: 'It appears to me that judges are making up the law as they go along.'      

Lord Tebbit caused a storm of protest in the 1980s when he said immigrants could only claim they had integrated into Britain after passing the 'cricket test' - by supporting English national sides in sporting competitions.

Mr Munawar now hopes to get a job with an accountancy firm and has plans to take part in an arranged marriage after his imam lined up a potential bride.

My dearest of bhais we must never forget that all sorts of Bangladeshi cricket enthusiasts come here to this site, I wouldn't want to hurt anyone's deep feeling about their faith/religion, I mean, "one man should never interfare with another's sacred and deep faith, another's religion" that is my interpretation from the Quran Surat Al-Imran. We moslems are already going through a time of harsh harrassment and distrust due to of course for a few of us, a small few group of terrorists' sins/wrong doings, the biger, greater picture/practice of Al-Islam gets turnished everyday and we are seen as someone who you cannot trust, let freely fly on an aircraft and there is this fear of co-existing with us moslems in a civilized society (mostly western, and mind you wetern society is a big part of our existence, even for our Islamic existence). Why would we even want to start even more sepreation, why would we even cherish the thoughts of Kadiyani, Ismailia, Sunni, Shiaat, Bihari, Sufi, Silva Merthod, Nations Of Islam, or Bedharmik? For our own benifit, it is imparative that we see all of us as Moslem (I mean all the different Islamic groups) and also seek what is good in each individual regardless of his and her faith, seek beauty, knowledge from all of them combined. Also faith is a very personal thing to begin with, we must learn to give room. Remember once the great Pakistani Armed forces, the attacking torturing, raping Pakistani Military Regime that eventually surrendered in Dhaka under gen. Niazi also used to look and treat us Bangali Moslems with a similar viewpoint, we were not moslem enough to be considered human next to them...we just celebrated 40th year of that victory a few weeks ago, we must not forget our past, history so soon, the key word here is to think, to learn and to remember! Who cares who is Kadiani, who is Shiaate or who is Sunni, we have many many people come to BC from all different different religious faith, ethnic background and practices, that is one of our major Strengths, our country was even founded on the concept of secularism. Please guys don't embarrass me!

Also I like to really honestly say that I am very very thrilled by this judge's disicion (spell) in the court, with this I have a much better higher respect for the British Judicial system, it to me seems more humane, respectfull to a human's human need and feelings, this judge really upholds that, I salute this judge, this is a great moment for human dignity, human judgement for another human!
