কবি মেহেরুননেসার কথা কি আমরা ভুলে যাবো? তার হত্যার এই বিচার? ১৫ বছরের কারাদন্ড! কবি মেহেরুননেসা ‘জনতা জেগেছে’ কবিতা লিখে বাঙালির জাগরণের পক্ষে কথা বলেছেন, তাতে পাকিস্তানীদের শত্রু হয়েছেন, রাজাকারদের শত্রু হয়েছেন। ২৭ মার্চ, ১৯৭১ তাকে হত্যা করা হয় বাঙালির মুক্তি সংগ্রামের পক্ষে কাজ করায়। তাকে এবং তার পরিবারের প্রত্যেক সদস্যকে কেটে টুকরা টুকরা করা হয়, মাথা কেটে সিলিং ফ্যানে ঝুলিয়ে দেয়া হয়। এই হত্যাকান্ডে প্রত্যক্ষ অংশগ্রহণ করেন কাদের মোল্লা। এই হত্যাকান্ড প্রমানিত হওয়া সত্ত্বেও রায়ে কাদের মোল্লাকে ১৫ বছরের কারাদন্ড দেয়া হয়েছে। এই রায় প্রহসন, এই রায় বেঈমানী। এই রায় আমরা মানবোনা। মেহেরুননেসার রক্তের সাথে বেঈমানী মেনে নেয়া হবেনা।
যুদ্ধাপরাধীদের মধ্যে সবচেয়ে ভয়ঙ্কর একজন এই কাদের মোল্লা। ‘মিরপুরের কসাই’ নামে কূখ্যাত এই রাজাকারের যদি বিরুদ্ধে যদি ন্যাজ্য বিচার না হয় তাইলে কার বিরুদ্ধে হবে? পলাতকের ফাসির রায় হয়, যে জেলে আটক তার হয় যাবজ্জিবন। বিচারের নামে প্রহসন হচ্ছে। রাজাকারের সাথে আপোষ হচ্ছে। এই আপোষ, এই বেঈমানী মেনে নেয়া হবেনা। আমরা লড়াই করবো। ব্লগে, ফেসবুকে, রাজপথে। বিন্দুমাত্র ছাড় দেয়া হবেনা। দলীয় এবং গোষ্ঠিগত স্বার্থে কেউ জনতার সাথে বেঈমানী করবেন না। দল মতের ঊর্ধে উঠে রাজাকারের বিচার দাবির জন্যে লড়াই শুরু করুন। এক দফা এক দাবি, “আমরা কাদের মোল্লার ফাঁসি চাই”।
এটা ছিয়ানব্বই সাল না। এটা ২০১৩ সাল। মেহেরুননেসার রক্তের কসম, আমরা লড়াই থামাবোনা, বাঙলার মাটিতে রাজাকারের ঠাই নাই।
আগামীকাল বিকাল ৫টায়, “জাতীয় স্বার্থে ব্লগার অনলাইন একটিভিস্ট” ফোরামের ব্যানারে আমরা একজোট হচ্ছি। প্রেসক্লাব থেকে শিখা চিরন্তন পর্যন্ত বিক্ষোভ মিছিল, তারপর সমাবেশ এবং তারপরে মশাল মিছিল। সমাবেশে পরবর্তি কর্মসূচী ঘোষনা করা হবে। আমাদের সাথে যোগ দিন। প্রত্যেক ব্লগার ও অনলাইন একটিভিস্টের কাছে আহবান রইলো, প্রত্যেক ব্লগ এবং প্রত্যেক ফেসবুক গ্রুপ এবং পেজএর কাছে আহবান রইলো নিজ নিজ ব্যানার নিয়ে উপস্থিত হন।
জাগুন। আমরা না জাগলে সকাল হবেনা।

I am not happy with this Kader Mullah's life imprisonment verdict, dont understand how he got life imprisonment for that 2nd, 5th, 6th charge. I thought he deserves death penalty.

As soon as the Government changes, it will turn out that Mollah has some 'mysterious, life threatening illness' and he will be released from prison on 'medical grounds' and quite probably flown to Singapore/Bangkok, all expenses paid.

ঢাকা বিশ্ববিদ্যালয় এলাকা এখন উত্তাল। ‘কসাই কাদেরের যাবজ্জীবন সাজা মানি না’, ‘আর কোনো রায় নেই, কাদের মোল্লার ফাঁসি চাই’, ‘রাজাকারদের সঙ্গে বসবাস করতে চাই না’, ‘একাত্তরের হাতিয়ার গর্জে উঠুক আরেকবার’ এসব স্লোগানে স্লোগানে মুখরিত ক্যাম্পাস।
আজ মঙ্গলবার বিকেল তিনটা থেকে শুরু হলেও এখনও চলছে বিক্ষোভ আর সমাবেশ। শাহবাগে প্রথমে অবরোধ শুরু করেন ব্লগার অ্যান্ড অনলাইন অ্যাকটিভিস্ট নেটওয়ার্ক। সংগঠক চিকিত্সক ইমরান এইচ সরকার বলেন, যুদ্ধাপরাধী জামায়াত নেতা কাদের মোল্লার যাবজ্জীবন নয় ফাঁসি চান তাঁরা। ট্রাইব্যুনালের দেওয়া রায়ের বিরুদ্ধে আপিল না হওয়া পর্যন্ত আন্দোলন চালিয়ে যাবেন তাঁরা। আগামীকাল বুধবার আরও বৃহত্তর আন্দোলন কর্মসূচি ঘোষণা করা হবে বলেও জানান সংগঠক ইমরান।

This was so obvious. but why did the govt cave in? 5 out of 6 charges proven and still it wasnt good enough? International pressure / under the table deals?? will we ever know?

Navo Bhai, who was the presiding judge in this matter - who was he appointed by?
How do regular judges get appointed? Is this a supreme court trial?
Or is the tribunal a special court?
Who do they report to?

Personally, I like many others, feel that the harshest possible sentence under the laws of the land should have been delivered against Mollah.
But from a judicial point of view, I don't understand how people who don't think the tribunal is either independent or impartial and susceptible to government machinations, can still call for sentences to be handed out (never mind death sentences). If you don't think the procedure is correct or legitimate, how can you think that the sentences are?
If we are to campaign for maximum sentences for these killers and perpetrators of crimes against humanity, then we have to accept the legitimacy of the tribunal, warts and all.

As much as we would like to believe otherwise, we all know how the judiciary system in our country works. Judges end up feeling embarrassed to conduct trial for Mujib's murder during the time of BNP rule. While the judges are fine when AL is in power. If it helps you sleep at night, you are free to believe in impartiality and independence of our justice system. However I can assure you that these sentences would never get carried out if AL was not in the realm of power.

As someone against the capital punishment, I am actually in support of the ICT's decision to give him life-imprisonment. However, I AM wary about how it would be enforced. Jail-times are unfortunately affected by the political winds in our country.

Haha, I am under no delusions about the political pressures prevalent in Bangladesh. My point wasn't that you HAVE to delude yourself into believing that the tribunals are fully impartial or independent, but you can't be so critical of it while also seeking justice from the same institution.
As this author notes:
"The trials have been dogged by controversy and legitimate questions have been raised about the process. But after so many years, many of them with the accused in or close to power, and with the nation's creaky and over-burdened legal apparatus, it was always going to be hard to deliver perfect justice.
But, for the most part, Bangladeshis feel that the trials have achieved the threshold level necessary for fairness, and that the justice they are dispensing is the closest to justice for 1971 we are ever likely to see."

They were appointed by the Government.
Section 6(1) of ICTA 1973 states:
"For the purpose of section 3, the Government may, by notification in the official Gazette, set up one or more Tribunals, each consisting of a Chairman and not less than two and not more than four other members."
The Chairman and the Members have to be drawn from the Supreme Court of Bangladesh (either High Court Division or Appellate Division)

I think I've answered this question before? The Chief Justice is appointed by the President and the other Supreme Court judges are appointed by the Chief Justice (with the recommendation of the President)
Also, for subordinate courts, appointments of persons to offices in the judicial service or as magistrates, exercising judicial functions shall be made by the President in accordance with rules made by him in that behalf.

No, it's not. Tribunals are distinct from courts and are often set up to deal with particular matters that need special expertise. Besides the ICT, which is for a very special and complex issue, we have administrative and industrial tribunals for instance.
This tribunal is constituted under section 6 (1) of the ICTA 1973 and is governed by its provisions. (However, that doesn't mean that the Constitution of the Republic is inactive) However, there are limited rights of appeal afforded, including an appeal to the Supreme Court of Bangladesh if need be. I am sure Jamaat is already formulating its appeals to the SC but with the case of Mollah, others might be appealing to the SC so as to push up his verdict from life imprisonment to death.
Technically, they report to no one. They're supposed to be independent. But, as I am sure you are no doubt aware, there have been discrepancies in this process. But I've read the salient portions of these judgments and I feel that they've reached the threshold of fairness, that we can reasonably expect.
Man, I should open a 'law thread' on BC...haha

You miss the point. Its not about money. If it takes 2 times more money to hang them, we will take it rather than feeding him for 15 years in a modified comfy jail locker !
